In this post we will understand what is technical resignation and its benefits. Before moving forward to Technical Resignation let us understand the basic difference between a Normal Resignation and a Technical Resignation.

In Normal Resignation the employee does not get pensionary benefits from service rendered in past whereas in Technical Resignation the employee gets benefits of service rendered in past. Let us understand everything about Technical Resignation in detail.

Technical Resignation

The resignation is treated as a technical formality where a Government servant has applied through proper channel for a post in the same or some other Department, and is on selection, required to resign from the previous post for administrative reasons.

What is the Criteria to avail benefit of past service 

1. The Government servant should intimate the details of such application immediately on her joining; 

2. The Government servant at the time of resignation should specifically make a request, indicating that she is resigning to take up another appointment under Government for which she had applied before joining the Government service;

3. The authority accepting the resignation should satisfy itself that had the employee been in service on the date of application for the post mentioned by the employee, his/her application would have been forwarded through proper channel.

Some Major Benefits of Technical Resignation

1. Carry forward of Leave benefits - Earned Leaves and Half Pay Leaves get carry forward in another department.

2. Carry forward of LTC - Eligibility period will include time spent in past service.

3. Pay Protection - Pay gets fixed as per past service in case switching on same grade pay/pay level. Eligibility of past service for reckoning of the minimum period for grant of Annual Increment.

4. New Pension Scheme - Balance gets carry forward to the new office.

5. Need for Medical examination - If joining new service within 6-12 months then there is no need for Medical Examination, however, if department wants then the employee has to undergo medical examination.

6. Transfer of Service Book from parent Department to present Department - Same service book will be transferred to new department. 

7. Verification of Character & Antecedents - Also known as Police Verification. If joining new service within 12 months then there is no need for Verification of Character & Antecedents, however, if department wants then the employee has to undergo.

8. Lien on a post - Once an employee completes two years probation period and gets confirmed in service, he/she can enjoy benefit of Lien.  It represents the right of a Government employee to hold a regular post, whether permanent or temporary, either immediately or on the termination of the period of absence.

9. Pension benefits:- Resignation from Government service with a view to secure employment in a Central public enterprise with proper permission will not entail forfeiture of the service for the purpose of retirement/terminal benefits. In such cases, the Government servant concerned shall be deemed to have retired from service from the date of such resignation and shall be eligible to receive all retirement/terminal benefits as admissible under the relevant rules applicable to him in his parent organization.

So, if you are a government employee and want to avail yourself the benefit of past service then always apply through proper channel and after selection tender your technical resignation rather than normal resignation.
